AFFILIATE PROGRAM FOR LANDSTAR ON THE GRANITE NETWORK

These Terms & Conditions (T&Cs) contain relevant information about your participation in the Affiliate Program for Landstar including mandatory arbitration of disputes, instead of class actions or jury trials. You will become bound by these provisions once you agree to participate in the program.

WHO IS THIS AGREEMENT WITH?

 

These T&Cs are an agreement between you (Landstar Operators, Agents, Affiliates, or Employees) and Granite Telecommunications, LLC (Granite). As a participant in this program, you will not have a contract or a direct relationship with T-Mobile or AT&T. All questions regarding service, these T&Cs and/or any disputes must be brought to Granite, not T-Mobile or AT&T. Granite is your “carrier of record,” and you are not considered a third-party beneficiary to Granite’s arrangement with T- Mobile, and AT&T.

WHAT IS INCLUDED IN THESE TERMS AND CONDITIONS?

In these T&Cs, you'll find relevant information about:

 

  • Description of services provided to you (Services);

  • Payment methods;

  • Privacy information;

  • What happens if you leave Landstar;

  • Limitations of liability; and

  • Resolution of disputes.

THE RATES AND PLANS

Granite on AT&T plans

 

Basic 2GB Pooled

 

Your charges are $29.99 per line, per month, excluding taxes and fees. This includes unlimited talk and text. 2GB of LTE data with no overages, video streaming up to 480p, and unlimited talk to Mexico and Canada. You may have to pay extra for calls to some numbers (e.g., conference & chat lines, broadcast, international, 900 or 976 calls, etc.). This is a month to month plan, and you can cancel at any time on thirty (30) days’ advance notice by notifying Granite at custserv@granitenet.com. There is no limit as to the number of lines you can have, but you cannot “resell” this plan to others. The following voice features are available to the extent that your phone is able to use the feature and the network capability can provide the feature: caller ID; call waiting; three-way calling; call forwarding and voicemail.

Unlimited Plan

 

Your charges are $59.99 per line, per month, excluding taxes and fees. This includes unlimited talk, text, and LTE data with no overages, video streaming up to 480p, and unlimited talk to Mexico and Canada. You may have to pay extra for calls to some numbers (e.g., conference & chat lines, broadcast, international, 900 or 976 calls, etc.). This is a month to month plan, and you can cancel at any time on thirty (30) days’ advance notice by notifying Granite at custserv@granitenet.com. There is no limit as to the number of lines you can have, but you cannot “resell” this plan to others. The following voice features are available to the extent that your phone is able to use the feature and the network capability can provide the feature: caller ID; call waiting; three-way calling; call forwarding and voicemail.

Granite on T-Mobile Plan

Your charges are $33.00 per line, per month, excluding taxes and fees. This includes unlimited talk, text, and data with no overages (includes 5GB per month of high-speed roaming in Canada and Mexico). You may have to pay extra for calls to some numbers (e.g., conference & chat lines, broadcast, international, 900 or 976 calls, etc.). This is a month to month plan, and you can cancel at any time on thirty (30) days’ advance notice by notifying Granite at custserv@granitenet.com. There is no limit as to the number of lines you can have, but you cannot “resell” this plan to others. The following voice features are available to the extent that your phone is able to use the feature and the network capability can provide the feature: caller ID; call waiting; three-way calling; call forwarding and voicemail.

PAYMENT

 

You authorize Granite to deduct monthly charges from a credit card you should provide at the time of activation. You will receive an electronic (paperless) bill delivered to your email address. If you leave Landstar commercial relationship or employment and you would like to continue receiving Service, you will need to maintain a valid credit card for automatic monthly credit card payments. Otherwise, the Service will be disconnected. In addition, if you port your number from Granite to another carrier, your Service will be deactivated.

PRIVACY

 

Granite respects your privacy. Granite will not monitor numbers you call or text or monitor the content or applications you access on your device. T-Mobile and AT&T will meter your total usage for network management purposes. Heavy data users will have their data usage prioritized below the data usage of other customers at times and at locations where there are competing customer demands for network resources, which may result in slower data speeds. Heavy data users are those who use more than 50GB of data in a billing cycle; however, this threshold is subject to change.

WHAT HAPPENS IF MY PHONE IS LOST OR STOLEN?

 

You agree to notify Granite if your phone is lost or stolen. Once you notify us, we will suspend your Service.

DISPUTE RESOLUTION

 

By accepting these T&Cs, you are agreeing to resolve any dispute with Granite through binding arbitration and to waive your rights to a class action suit and a jury trial. You must notify Granite in writing to custserv@granitenet.com of any dispute regarding your bill or charges to your account within 60 days after the date you first receive the disputed bill or charge. If you don’t, you may not pursue a claim. Unless otherwise provided by law, you must pay disputed charges until the dispute is resolved. In no event will Granite or T-Mobile and AT&T be liable for any cost, delay, failure or disruption of Service, lost profits, or incidental, special, punitive or consequential damages.

CAN GRANITE CHANGE THIS AGREEMENT OR TERMINATE THE GRANITE T-MOBILE AND AT&T AFFILIATE PROGRAM FOR LANDSTAR?

Yes. Granite may change, limit, suspend or terminate the Service, this Agreement or the Granite T-Mobile and AT&T Affiliate Program for Landstar at any time, including if you engage in any of the prohibited uses described or no longer reside in a T-Mobile or AT&T network coverage area. Under certain limited circumstances, Granite may also block your device from working on the T-Mobile and AT&T network. If the change to your Service will have a material adverse effect on you, we will provide at least 14 days’ notice of the change. By using the Service after the effective date of the change, you will agree to the change.

DISCLAIMER OF WARRANTIES

 

The Service is provided on an “as is” and “with all faults” basis and without warranties of any kind. Granite makes no representations or warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose concerning your Service. Granite can’t and doesn’t promise uninterrupted or error-free service and doesn’t authorize anyone to make any warranties on Granite’s behalf. This doesn’t deprive you of any warranty rights you may have against anyone else. Neither Granite nor T-Mobile and AT&T guarantees that your communications will be private or secure; it is illegal for unauthorized people to intercept your communications, but such interceptions can occur. Service may be temporarily refused, interrupted, curtailed or limited because of atmospheric, terrain, or other natural or artificial conditions and may be temporarily interrupted or curtailed due to usage concentrations, modifications, upgrades, relocation, and repairs of the transmission network. You agree that neither Granite nor T-Mobile and AT&T is responsible for such interruptions of the Service or the inability to use the Service.

 

Please review all terms and conditions of third-party products. Neither Granite nor T-Mobile and AT&T are responsible for failures to connect or complete 911 calls or text to 911 messages or if inaccurate location information is provided. 911 service may not be available or reliable, and your ability to receive emergency services may be impeded. We cannot assure you that if you place a 911 call or text, you will be found.

Granite is not responsible for any download, installation, use, transmission failure, interruption, or delay related to Content & Apps, or any third party content, services, advertisements, or websites you may be able to access by using your Service. You are responsible for maintaining anti-virus and other Internet security protections when accessing third party Content & Apps or other services.

 

LIMITATION OF LIABILITY

 

To the extent permitted by law, you and Granite each agree to limit claims for damages or other monetary relief against each other to direct and actual damages regardless of the theory of liability. This means that neither of us will seek any indirect, special, consequential, treble, or punitive damages from the other. This limitation and waiver also apply to any claims you may bring against any other party to the extent that we would be required to indemnify that party for such claim. You agree that neither Granite nor T-Mobile and AT&T are liable for problems caused by you or a third-party, or by any act of God. You also agree that neither Granite nor T-Mobile and AT&T are liable for missed or deleted voice mails or other messages, for any information (like pictures) that get lost or deleted, or for failure or delay in connecting a call or text to 911 or any other emergency service. To the extent permitted by law, you and Granite each also agree that all claims must be brought within two years of the date the claim arises.

 

INDEMNIFICATION

 

You agree to defend, indemnify, and hold Granite, T-Mobile, and AT&T harmless from any claims (including reasonable attorneys’ fees and costs) arising out of use of the Service, breach of the Agreement, or violation of any laws or regulations or the rights of any third party by you, any person on your account or that you allow to use the Service. This provision survives termination of the Agreement.

 

PROHIBITED USES OF THE SERVICE

 

Unless explicitly permitted by Granite, you are not allowed to use the Service in a way that Granite determines:

 

  • Compromises network security or capacity, degrades network performance, uses malicious software or “malware,” hinders other Granite employees access to the network, or otherwise adversely impacts network service levels or legitimate data flows;

  • Uses applications which automatically consume unreasonable amounts of available network capacity;

  • Uses applications which are designed for unattended use, automatic data feeds, automated machine-to-machine connections, or applications that are used in a way that degrades network capacity or functionality;

  • Misuses the Service, including "spamming" or sending abusive, unsolicited, or other mass automated communications;

  • Accesses the accounts of others without authority;

  • Results in more than 50% of your voice and/or data usage being off-net (i.e., connected to another provider’s network) for any three billing cycles within any 12 month period;

  • Resells the Service, either alone or as part of any other good or service;

  • Violate anyone’s intellectual property rights;

  • Causes harm or adversely affects Granite, the network, our customers, employees, business, or any other person;

  • Conflicts with applicable law;

  • Is not in accordance with these T&Cs; or

  • Attempts or assists or facilitates anyone else in any of the above activities.

 

 

TAXES AND SURCHARGES

 

Taxes: You agree to pay all taxes and fees imposed by governments or governmental entities. We may not give advance notice of changes to these charges. To determine taxes & fees, we use the address of the Granite headquarters. Taxes and fees may change from time to time without notice.

 

Surcharges: You agree to pay all surcharges. Surcharges are not mandated or imposed on you by law; they are Granite charges that are determined, collected and retained by us. The components and amounts of the surcharges are subject to change without notice. Surcharges include charges, costs, fees and certain taxes that Granite incurs to provide the Services. Examples include general and administrative fees (such as certain costs we incur to provide Service) as well as governmental-related assessments (such as Federal or State Universal Service fees, regulatory or public safety charges, environmental fees, and gross receipts taxes). Surcharges may change from time to time without notice.

 

ADDITIONAL TERMS

 

If Granite doesn’t enforce our rights under this Agreement in one instance, that doesn't mean we won't or can't enforce those rights in any other instance. If any part of these T&Cs are held invalid that part may be severed from the Agreement.

 

You can't assign or transfer the Agreement or any of your rights or duties under it without Granite’s written consent. Granite may assign or transfer all or part of the Agreement, or your debts to us, without notice. You understand that the assignment or transfer of all or any part of this Agreement or your debt will not change or relieve your obligations under this Agreement.

 

The Agreement is the entire agreement between you and Granite regarding the rights you have with respect to the Service, except as provided by law, and you cannot rely on any other documents or statements by any sales or service representatives or other agents, including T-Mobile and AT&T.
